1. INTRODUCTION

Welcome to Real Luxury Real ("Company," "we," "our," "us"). These Terms of Service ("Terms") govern your use of our website and our luxury authentication services, including digital authentication reports and certificates of authenticity (collectively, the "Service").

By accessing our website or purchasing our authentication services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. OUR SERVICES

We provide professional luxury goods authentication services based on photos and videos submitted by you. Our services include:

  • Digital Authentication Report – A detailed analysis of your item's authenticity based on submitted images

  • Certificate of Authenticity – An official document confirming the authenticity status of your item

We do not require you to mail your physical item to us. All authentication is performed remotely using high-resolution photos and videos.

3. ELIGIBILITY

By using our Service, you represent and warrant that:

  • You are at least 18 years old

  • You have the legal capacity to enter into a binding agreement

  • You are the owner of the item you submit for authentication or have explicit permission from the owner

  • All information you provide is accurate, complete, and truthful

4. SUBMISSION REQUIREMENTS

4.1 Required Materials

To complete an authentication, you must submit:

  • Clear, high-resolution photos of the item (logos, date codes, stitching, hardware, serial numbers)

  • Videos (if requested) showing holograms, moving parts, or other dynamic features

  • Any provenance documentation (receipts, original certificates, previous authentication reports) – optional but recommended

4.2 Insufficient Submissions

If your photos or videos are insufficient for accurate authentication, we will:

  • Notify you within 2 business days

  • Request additional images or information

  • Allow you 7 days to provide the requested materials

If you fail to provide sufficient materials within 7 days, we may cancel your request with a 50% refund (work already performed).

4.3 Prohibited Submissions

You may not submit for authentication:

  • Items you do not own or have permission to authenticate

  • Illegal or stolen items

  • Items containing prohibited materials (e.g., endangered species parts)

5. AUTHENTICATION PROCESS

5.1 How It Works

  1. You submit photos and videos through our website

  2. We review your submission for completeness

  3. Our authenticators analyze the images using proprietary methods, including AI-assisted image recognition

  4. We deliver a digital authentication report within the stated timeframe

  5. A Certificate of Authenticity is issued if requested and if the item is determined to be authentic

5.2 Timeframe

Authentication typically takes 1 to 5 business days from the time we receive clear and sufficient photos. Complex items may require additional time. We will notify you of any delays.

5.3 No Physical Handling

Because we operate remotely, we never physically handle your item. Our authentication is based solely on the visual information you provide. The accuracy of our assessment depends significantly on the quality and completeness of your submission.

6. ACCURACY AND LIMITATIONS

6.1 Our Commitment to Accuracy

We strive for the highest level of accuracy in our authentication services. Our authenticators are trained professionals, and we use multiple verification methods including AI-assisted analysis.

6.2 No Guarantee of Absolute Certainty

Important: Authentication is an expert opinion, not an absolute guarantee. While we are highly accurate, no authentication method is 100% infallible. Our reports represent our professional judgment based on the information provided.

6.3 Limitations

Our authentication is limited by:

  • The quality and completeness of photos and videos you submit

  • The absence of physical inspection (touch, smell, weight, material feel)

  • Limitations of remote analysis compared to in-person examination

6.4 Not an Appraisal

Our authentication service determines authenticity only (whether an item is genuine or counterfeit). We do not provide:

  • Monetary appraisals or valuations

  • Estimates of resale value

  • Investment advice

7. FEES AND PAYMENT

7.1 Service Fees

Authentication fees are displayed on our website before you purchase. All fees are in the currency stated at checkout.

7.2 Payment Methods

We accept payments through Shopify Payments, Stripe, PayPal, and major credit cards.

7.3 No Hidden Fees

There are no hidden fees. The price you see at checkout is the price you pay.

8. REFUNDS AND CANCELLATIONS

Refunds are governed by our separate Refund Policy, which is incorporated into these Terms by reference. Please review our Refund Policy for detailed information about:

  • Refundable situations (service not performed, duplicate payment, technical error)

  • Non-refundable situations (unfavorable results, change of mind, insufficient photos)

9. INTELLECTUAL PROPERTY

9.1 Our Property

All content on our website, including text, images, logos, authentication methodologies, and reports, is the property of Real Luxury Real and is protected by copyright and trademark laws.

9.2 Your Property

You retain ownership of all photos and videos you submit. By submitting materials, you grant us a non-exclusive, royalty-free license to:

  • Use the images for authentication purposes

  • Retain anonymized images for AI training and quality improvement

  • Use anonymized counterfeit images in anti-counterfeiting databases (without your personal information)

9.3 Confidentiality

We will not share your personal information or identifiable item images with third parties except as described in our Privacy Policy.

10. PROHIBITED CONDUCT

You agree not to:

  • Submit counterfeit items knowingly and claim they are authentic

  • Manipulate or edit photos in a way that misrepresents the item

  • Use our Service for illegal purposes

  • Reverse engineer, copy, or steal our authentication methods

  • Harass or threaten our employees or authenticators

  • Submit fraudulent payment information

  • Create multiple accounts to bypass restrictions

Violation of these prohibitions may result in immediate termination of your access and a permanent ban from our Service.

11. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law:

  • Our Service is provided "as is" and "as available"

  • We do not warrant that the Service will be uninterrupted, error-free, or secure

  • We make no warranties beyond those expressly stated in these Terms

  • Authentication results are professional opinions, not absolute guarantees

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • Our total liability to you for any claim arising from our Service shall not exceed the amount you paid for the specific authentication service at issue

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages

  • We are not liable for any loss of value, lost profits, or lost opportunities resulting from reliance on our authentication report

  • We are not liable for any actions you take (or fail to take) based on our authentication results

Example: If you sell an item based on our "authentic" determination and the buyer later disputes authenticity, our liability is limited to the authentication fee you paid.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Real Luxury Real and its employees, authenticators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of our Service

  • Your violation of these Terms

  • Your submission of false or misleading information

  • Your infringement of any third-party rights

14. THIRD-PARTY DISPUTES

If you use our authentication report in a transaction with a buyer, seller, or platform (e.g., eBay, The RealReal, Vestiaire Collective), and that third party disputes our finding:

  • We are not a party to your transaction

  • We are not responsible for the outcome of any dispute between you and a third party

  • We may, at our discretion, provide a secondary review or affidavit to support your claim, but we are not obligated to do so

15. MODIFICATIONS TO SERVICE AND TERMS

15.1 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last Updated" date

  • Sending an email to registered users

Your continued use of our Service after changes become effective constitutes your acceptance of the revised Terms.
